1. About these terms
By accessing or using this website, you agree to these Website Terms of Use. If you do not agree, please do not use the website. References to “Curzey”, “we”, “us” or “our” mean Curzey Design Studio, based in Nairobi, Kenya.
These website terms do not replace the terms of any separate proposal, appointment, consultancy agreement, design-and-build contract, quotation, purchase order or other written agreement entered into between Curzey and a client. If there is a conflict, the signed or formally accepted project agreement governs the project relationship to the extent of that conflict.
2. Website information is not a project appointment
The website is intended to explain our services, share design and project knowledge, showcase selected work and help prospective clients explore or communicate project requirements. Website content is general information and does not, by itself, constitute architectural, engineering, quantity-surveying, legal, financial, health-and-safety or other regulated professional advice.
Sending an enquiry, using a planning calculator, generating a project brief or booking a consultation does not by itself appoint Curzey, create a construction contract, reserve project capacity or bind either party to a price, programme or scope. A project commitment arises only through the applicable formal acceptance process.
3. Public planning tools and generated outputs
Our website may provide planning tools, budget indications, timeline assessments, complexity assessments, procurement guidance, sustainability prompts, project briefs or other generated outputs. These are decision-support tools based on the information available at the time. They are indicative and may use assumptions, ranges or simplified models.
You remain responsible for verifying project information and obtaining any specialist advice, surveys, approvals, statutory consents, quotations or professional services appropriate to the project before relying on an output for a material decision. Actual project cost, duration, technical feasibility and procurement conditions can change after site investigation, design development, market testing and contractor or supplier engagement.
4. Information you submit
You are responsible for ensuring that information you submit is accurate to the best of your knowledge and that you are entitled to provide it. Please do not upload, enter or send confidential information belonging to another person or organisation unless you have authority to do so.
You retain ownership of material that you lawfully provide to us. You grant Curzey a limited right to use that material as reasonably necessary to operate the website, respond to your enquiry, evaluate the prospective project and, if a project proceeds, administer the resulting client or project relationship subject to the applicable agreement and our Privacy Policy.
5. Intellectual property
Unless otherwise stated, the website and its original text, graphics, interface design, branding, methodologies, diagrams, photographs, videos, project presentation material and other content are owned by or licensed to Curzey and are protected by applicable intellectual-property law. Third-party trade marks, photographs or other material remain the property of their respective owners.
You may view and use the website for legitimate personal or internal business evaluation. You may not reproduce, republish, sell, scrape, systematically extract, distribute, modify or commercially exploit substantial website content without our written permission or another lawful basis.
6. Portfolio and project material
Project images and case studies are provided to communicate design intent, experience and completed work. They may include work delivered with clients, consultants, contractors, suppliers or previous project teams. Publication does not transfer any third-party intellectual-property right, confidentiality right or trade mark to the visitor.
7. Acceptable use
You must not use the website to break the law, infringe another person's rights, submit malicious code, probe or bypass security, interfere with the service, misuse automated access, impersonate another person, attempt unauthorised access to another visitor's public project workspace, or use the website in a way that could damage Curzey, our infrastructure or other users.
8. Availability and changes
We aim to keep the website useful and available, but we do not promise uninterrupted or error-free operation. We may change, suspend or withdraw content or functionality for maintenance, security, legal, commercial or technical reasons. Public project drafts and tool results are not intended to be permanent document-storage services and may expire in accordance with the retention periods described in our Privacy Policy.
9. Third-party services and links
The website may link to or rely on third-party platforms, hosting, email, map, social-media or other services. Those third parties operate under their own terms and privacy practices. A link does not necessarily mean Curzey endorses every statement, service or practice of the linked site.
10. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful. Subject to that qualification, Curzey is not responsible for loss arising solely from treating general website content or an indicative planning output as a substitute for a project-specific professional appointment, verified site information or an accepted commercial agreement.
Where the law permits, we are not liable for indirect or consequential loss caused by website interruption, loss of an unsubmitted draft, third-party service failure, malware originating outside systems under our reasonable control, or use of the website contrary to these terms.
11. Privacy
Our collection and use of personal data through the website is described in our Privacy Policy. The Privacy Policy forms the primary notice for website data processing and should be read alongside these terms.
12. Consumer and statutory rights
Nothing in these terms is intended to remove a right or remedy that cannot lawfully be excluded under Kenyan consumer, data-protection, intellectual-property or other applicable law. If you use the website as a consumer and mandatory law gives you stronger protection than a provision in these terms, the mandatory protection prevails.
13. Governing law and disputes
These Website Terms are governed by the laws of Kenya. Subject to any mandatory consumer right or other law that requires a different forum, disputes concerning these terms or the website are subject to the jurisdiction of the courts of Kenya. The parties may first attempt to resolve a dispute in good faith through direct discussion or another mutually agreed dispute-resolution process.
14. Changes and contact
We may revise these terms when the website, our services or applicable law changes. The effective date at the top of the page identifies the current version. Questions about these terms may be sent to info@curzeystudio.com.
